Grant of Probate

In Victoria if you die with individual assets in excess of fifty thousand dollars in your own name your executor must obtain a Grant of Probate of your Will.

Until such time that a Grant of Probate has been granted to an executor the executor is not legally entitled to deal with the assets of the estate.

We assist you with the application of the Grant of Probate and take away the complexity of making an application of the Grant of Probate with the Court.

We meet with you to explain the Probate process and what information we require from you in order to prepare the appropriate Probate documents and we provide tips and guidance along the way together with answering any questions you may have.

Letters of Administration

In Victoria if you die with individual assets in excess of fifty thousand dollars in your own name and you did not have a Will in place then your next of kin must apply for Letters of Administration in order to deal with the assets of your estate.

Until such time that Letters of Administration has been granted to a next of kin the next of kin is not legally entitled to deal with the assets of the estate.

We assist you with the application of Letters of Administration and remove the complexity of making an application of the Letters of Administration with the Court.

We meet with you to explain the Letters of Administration process and what information we require from you in order to prepare the appropriate Letter of Administration documents and we provide tips and guidance along the way, together with answering any questions you may have.

Administration of Deceased Estates

Once a Grant of Probate or Letters of Administration have been granted the executor or next of kin must administer the deceased’s estate until such time that the assets may be distributed to the beneficiaries in accordance with the provisions of the deceased’s Will.

This may include selling or arranging transfer of property, shares, motor vehicles and other assets belonging to the deceased. They will also need to attend to the payment of any outstanding liabilities left by the deceased together with estate expenses. A final tax return will also need to be finalised prior to the assets of the estate being distributed.

We can assist with the administration of a deceased estate and liaise with financial advisors, accountants, real estate agents, banks and other relevant parties on your behalf.

Property Transfers

In cases were the deceased jointly owned property with other parties we can assist in the transfer of the deceased’s equity in the property to the surviving parties.

We can also assist in the transfer of the deceased’s property to the Executor in their Capacity as Legal Personal Representatives.

We also assist clients in the transfer of the deceased’s property to a beneficiary.

For properties that the deceased left that are to be sold by the executor we can assist executors with the conveyancing in respect to the sale of such properties, inclusive of providing the Contract of Sale and Section 32 Vendor Statement
